Privacy Policies
UN JARDÍN PROPIO, in compliance with the Federal Law on the Protection of Personal Data Held by Private Parties, issues this Privacy Policy, given that it receives and stores personal data of its clients, employees, and suppliers, carrying out legitimate, controlled, and informed processing that guarantees their privacy rights and the appropriate use of said data for the manufacture and sale of silver jewelry, carrying out procedures before public authorities and institutions such as the IMSS and Infonavit, as well as for contracting major medical expense insurance policies, administrative procedures for hiring employees and suppliers of the company in its different areas, payroll and commission payments, control of collective account balances, resource management, establishing contact and communication with clients and suppliers, sending quotes, invoicing, price changes, etc., as well as the internal control of the different activities that must be carried out to perform the company's business.
I.- IDENTIFICATION OF THE DATA CONTROLLER AND PROCESSING OF YOUR PERSONAL DATA
In accordance with the provisions of Article 17, section II of the Federal Law on the Protection of Personal Data Held by Private Parties, we inform you that UN JARDÍN PROPIO. (the “Controller”), with address at Juana de Arco 75, Col. Moderna, Benito Juárez, 03510, CDMX (the “Contact Address”), will process the personal data it collects from you in accordance with the terms of this Privacy Policy.
II.- PURPOSES
The treatment will be carried out for the following purposes:
a) Necessary for the legal relationship with the Responsible Party:
To obtain the necessary information from clients and suppliers to manage the labor, commercial, and industrial relationship for the manufacture and sale of silver jewelry, as well as to maintain communication via email and telephone with clients and suppliers, establishing contact for matters related to our labor, commercial, and industrial relationship, invoicing, price changes, etc. Likewise, for procedures with the Mexican Social Security Institute (IMSS) and the National Housing Fund Institute (Infonavit), as well as for contracting major medical expense insurance policies, and for hiring employees and suppliers of the company. The personal data requested is as follows:
- Customer information: full name; address; telephone; email address; RFC registration certificate; proof of address (in the case of a legal entity); among others.
- From Suppliers: RFC registration certificate; full name; address; telephone; email address; voter ID of the individual or, if applicable, of the legal representative of the legal entity; proof of address (in the case of a legal entity); bank details, such as account number, interbank CLABE and bank; among others.
iii. For employees: birth certificate; proof of address; voter ID; CURP; Infonavit withholding letter (if applicable); letter of recommendation from previous job; job application or resume.
b) Others:
- To transfer your personal data to third parties, in accordance with the Privacy Policy.
Therefore, and in order to achieve the purposes stated above, the following personal data will be processed: name, surnames, address, telephone, email, RFC, CURP, bank details such as account number and interbank CLABE, among others.
III.-OPTIONS TO LIMIT THE USE OR DISCLOSURE OF PERSONAL DATA
The Controller has appointed a personal data officer (the “Privacy Officer”), therefore you may limit the use or disclosure of your personal data in person before “the Controller”, at the company address indicated above.
IV.- Means to revoke consent for the processing of personal data.
You may revoke your consent for the processing of your personal data in the same way you granted it. If, after revoking your consent, you request confirmation, the Data Controller will respond expressly.
V.- MEANS TO EXERCISE THE ARCO RIGHT
You have the right to (i) access your personal data in our possession and know the details of its processing, (ii) rectify it if it is inaccurate or incomplete, (iii) cancel it when you consider that it is not required for any of the purposes indicated in this Privacy Policy, is being used for purposes not consented to or the contractual or service relationship has ended, or (iv) oppose its processing for specific purposes, as stated by the Law, (collectively, the “ARCO Rights”).
To exercise your ARCO Rights, you must submit a request (the “ARCO Request”) to the Responsible Party, to the attention of the Privacy Officer, at the Contact Address, accompanied by the following information and documentation.
- Your name, address and email address so that we can communicate the response to the ARCO Request.
- A copy of the documents that prove your identity (copy of IFE, passport or any other official identification) or, if applicable, the documents that prove your legal representation, the original of which you must present in order to receive the response from the Responsible Party.
- A clear and precise description of the personal data regarding which you seek to exercise any of the ARCO Rights.
- Any document or information that facilitates the location of your personal data; and
- If you request a correction of your personal data, you must also indicate the modifications to be made and provide the documentation that supports your request.
The Privacy Officer will respond to your ARCO Request and explain the reasons for their decision via email within a maximum of 20 business days from the date your ARCO Request was received. If the ARCO Request is granted, the requested changes will be made within a maximum of 15 business days. The Data Controller may notify you within the timeframes mentioned in this paragraph of a one-time extension for a period equal to the original timeframe.
The Controller may deny access (the “Denial”) for you to exercise your ARCO Rights, in the cases permitted by law, and must inform you of the reason for such decision.
The refusal may be partial, in which case the Responsible Party will carry out the access, rectification, cancellation or opposition in the appropriate part.
Exercising your ARCO rights is free of charge. However, if you submit a request within a period of less than twelve months, the cost will be three days of the current General Minimum Wage in Mexico City, plus VAT, unless there are substantial modifications to the Privacy Policy that warrant new ARCO requests. You will be responsible for covering any justified shipping costs or the cost of reproducing copies or other formats, and, if applicable, the cost of document certification.
VI.- CHANGES OR MODIFICATIONS TO THE PRIVACY POLICY
The Data Controller reserves the right to make modifications or updates to this Privacy Policy at any time, with the understanding that any modification to it will be made known to you by means of the publication of a notice on the Data Controller's website, so we recommend that you check it frequently.
In the event of a security breach at any stage of the processing of your personal data that significantly affects your property or moral rights, the Privacy Officer will immediately notify you by email of the breach so that you can take the necessary steps to protect your rights. If we do not have your email address, the notification will be published on the Data Controller's website.
VII.- CONSENT
I give my consent for the processing of my personal data for the purposes necessary for the legal relationship with the Controller (Refusal to the processing of your personal data will result in the impossibility of establishing a legal relationship with the Controller).
